In the event of a separation, time limitations need to be observed. For a de facto relationship, any application for an adjustment of property under the Family Law Act must be commenced within two years of separation. In a marital separation, the time limits commence from the date that the divorce comes into effect and any application for an adjustment of property under the Family Law Act must be commenced within one year.
